Dear Friends and Supporters:
We are truly grateful for all the support and sympathy expressed over the past months towards the case pending against Nativo Lopez. It looks like we can see the light at the end of the tunnel, but there are probably several more court hearings before us.
We are asking for your presence and support for the next court hearing, which will occur on Thursday, May 20, 2010 at 9:00 a.m. at the Los Angeles Superior Court, Dept. 36 (3rd floor) located at 210 W. Temple Street, Los Angeles, CA 90012.
As you know, this case was initiated by the California Secretary of State and the Los Angeles County District Attorney’s Office, stemming from allegations of an improper use of residence domicile for the purpose of voter registration and voting, which resulted in the filing of eight felony charges against Nativo Lopez in June of 2009. The alleged incidents occurred in 2006 and 2007.
After numerous hearings and a “mental competency hearing,” during which Nativo was arrested for refusing to answer the judge in the manner which she demanded, and thereby not conceding legal jurisdiction to the court over his person and property, the court has not even concluded the preliminary hearing as it inches closer to one full year since the original charges were filed by the District Attorney. This is quite unusual.
The case is somewhat similar to the investigation that the District Attorney’s office launched against Los Angeles Councilman Richard Alarcon in January 2010 based on allegations that the San Fernando councilman does not live in the residence location within his council manic district listed as his official residence for the purpose of voter registration and voting, and in Alarcon’s particular case, representation of his “constituents.”
We know that it is extremely common for businesspersons, elected officials, students, and people who travel frequently to use numerous addresses for residence and domicile for voting. As long as they vote in only one precinct and only once, the gray area of interpretation of domicile is just that – an interpretation; and it does not warrant multiple felony counts.
Nativo was never accused of voting in numerous precincts or more than once at any given election time. The multiple charges of electoral fraud are an over-reach by an extremely politically ambitious Republican District Attorney, Steve Cooley, who is now a statewide candidate for California Attorney General in the Republican Party election primary set for June 2010.
However, Nativo would say that he has no desire to dispute the facts, be an adverse party in the court, argue with the judge or make statements, or in any way dishonor the court. He has a remedy to provide to the court and has worked assiduously to make this remedy available to the court to set-off the charges, settle the matter, and close the case. The court has refused to date to concede to his offer.
Each court hearing is truly an experience in understanding the workings of the court, the power of common law private remedies, the application of commercial law, and the ability of a natural man or woman to walk into a courtroom, without a lawyer (an officer of the court who owes his first loyalty to the court, and not to his client), and present a reasonable option to resolve what appears as an intractable controversy.
Be present on May 20, 2010 for such a teaching and learning moment and observe first-hand how one of our own political leaders presents himself before the court.
