norm firecracker westwellThere’s always that debate:  Ignore the lies and bullshit, or draw attention to them by debunking them?  I got a lotta people down in Huntington Beach trying to get me to debunk the lies being thrown at Ocean View School District President Gina Clayton-Tarvin, a rare politician with the balls to go after a big local player – Rainbow Disposal now owned by Republic – so of course she gets a lot of lies thrown at her.  We’ll do that.  But let me first catch you up a bit:

1. Driving hate-filled former journalist [and new OC Weekly Scariest Person] Chris Epting utterly apoplectic, popular conservative HB Councilman Erik Peterson endorsed Gina a week or two ago;  here are his words:

I have endorsed Gina Clayton-Tarvin for re-election to the Ocean View School District – and I’ll tell you why. But first, let me emphasize that I do NOT support Proposition 55, because I don’t trust anyone in Sacramento to do the right thing with the money. As far as OVSD’s Measure R goes, the board put it out there because they feel that they need it, and it’s up to them to show that they really do need it, and to convince us that they’ll be responsible with the funds if they get them. But now let me tell you why I support Gina.

For the last two years in office I have had the opportunity to work with her behind the scenes as a liaison to the school districts, as well as on specific issues between the city and the district. I have always appreciated the fact that she thinks not only of her district, but of the community as a whole.

The school district and the city are two separate jurisdictions, yet we often get intermingled through land lease, public safety, and other common areas. I have seen Gina and the board promote and stand behind the council’s goal of preserving open space, and taking stands on the negative impact of high-density development for the community and the district. I have seen Gina stand up for the students of the district, and have heard from many teachers I respect that she has done a great job.

I live in the district, and both of my sons went through the OVSD from Kindergarten to 8th grade. Now one is in college studying engineering, and the other is at Marina High School. OVSD did a great job for my family, and I believe it will continue to do a great job for many other families. I also feel the district will continue to be a good partner with the city, and that Gina will help to keep that relationship strong.

And a coupla other things – it SEEMED like it took till the last minute for the pro-Rainbow, pro-Epting, pro-Chamber forces to find someone to run against Gina … and looking at who they ended up with, they scraped the very bottom of the barrel.  Meet long-time HB “libertarian” crank Norm “Firecracker” Westwell, a dude with SERIOUS anger-management issues, who also advertises himself thusly (try not to think about sex and unicorns at the same time….)

And to keep Gina out of power, Norm had to have a running mate, which he found in unknown Kathryn Gonzales.  Here’s the FPPC complaint against her, still being investigated.  Now let’s move on to debunking the lies on Norm’s hate site, brilliantly entitled “Crooked Gina.

Here is a fact-checked sheet concerning the lies, misinformation, and deliberate manipulations of the “truth” from the “Crooked Gina” hate site being sold as “Sunshine Tarvin” site and as you can see it is a collection LIES. It is in every way a hate site. Is Norm Westwell the author? As uncovered by resident and tech expert Mark Bixby, there is glaring proof that he is. Here is a list of real facts about our school board president and the changes she has created in the OVSD. The truth always prevails.  What appears are lies from Norm Westwell’s hate website and then follows are facts from reality as substantiated by OVSD Board Policy, CA Education Code, LA Times articles, OVSD Board Minutes, FPPC Sworn Complaints.

Things that have changed since Tarvin took over:

LIE: In one calendar year a 7% raise was given to all employees: 1% given on August 18, 2015 and October 20, 2015; and additional 6% given on March 22, 2016 and April 12, 2016

FACT: After ten years of NO salary increases and multiple furlough days, a 1% increase was given in 2014-2015 fiscal year and a 6% increase for the 2015-2016 fiscal year. School district budgets are run per Fiscal Year, from July to July, NOT calendar year. Despite these increases, OVSD pay still remains the lowest in all of Orange County and most employees pay $1,000 out of pocket for HMO health insurance to further decrease take home pay.

LIE: Three schools shut down for containing asbestos – At a cost of over $20Million the decision was made to leave asbestos in the schools. It would have cost only $500,000 to completely remove the asbestos and a 2-week delay. Gina Clayton-Tarvin led the Board to keep the asbestos so Hope View (where her child attended) would not have a delay in the schedule.

 FACT: It cost far less to abate Hope, Oak, and Lake at $15M. To abate 100% of the already encapsulated minuscule amounts of possible asbestos, it would have cost over a $1M per school. A board majority decided to go with the preferred method of full abatement of classrooms instead. Under the mismanagement of the previous construction manager, children at Hope View were subjected to unsafe construction work practices that led to kids being exposed to construction dust and chemicals, the fire alarm being pulled due to a smoke cloud from work being done inside the building and construction workers without criminal background checks being near children. Tarvin attempted to stop this, but the board majority of Cotton, Pellman, and Ortiz ignored this and even skipped a public meeting, the night before school started to avoid facing concerned parents. LIE: Parents must be fingerprinted at their own cost to volunteer

FACT: Trustee Debbie Cotton argued at repeated board meetings that all parents, even molesters have the RIGHT to have access to any and all students at any time on OVSD campuses. Trustee Clayton-Tarvin vehemently disagrees.  At the request of the community a new Volunteer Policy was created to safeguard our children from being contacted by child molesters.  There is knowledge that there are those with Megan’s law registry trying to access our children while volunteering. OVSD policy does not charge parents to volunteer, it defines that those who wish to work more than 5 hours per week or to go on certain field trips to get “livescanned” due to student contact time. Like school employees who are required by law to get fingerprinted, this is for student safety. (Per Minutes, Special Board Meeting May 31, 2016)

 LIE: Removal of Saturday Academy by OVSD Board (January 13, 2015 Board Minutes)

 FACT: The superintendent, not board, removed Saturday Academy. The program created massive labor costs, wasting tax dollar to run the program that had no state mandated curriculum. The program facilitator, a private business called ARC, whose owner is a neighbor and personal friend of past OVSD Trustee Pellman and Trustee Debbie Cotton was profiting off public money to run Saturday Academy. Wasting public funds and cronyism at its worst.

 LIE: Reduced the community input and transparency by reducing the number of members on the Community Budget Advisory Committee (CBAC). (February 3, 2015 Board Minutes/Board Policy and Administrative Regulation 3100)

FACT: Streamlined process to mirror City Council Committee/Advisory Board Appointments (2 appointees per Board Member) for community and board accountability to get real input from the community.

 LIE: Moved meeting start time from 7PM (closed session 6 pm) to 6 PM (closed session 5 pm) to reduce working parent/community input. (February 3, 2015 Board Minutes/Board Policy and Administrative Regulation 9322)

 FACT: Public meetings were moved to 6pm so that more business could be completed earlier and late night meeting endings, that waste tax dollars would end. Parents and employ time should be valued and respected, they need to be at home with their families, not waiting for late Board Members to arrive due to their own work schedules. Over the years, Trustee Tracy Pellman was tardy over a hundred times and was a no-show on the eve of the night before the first day of school, in September 2014, during the asbestos problems. Most meetings under the leadership of Tracy Pellman and Debbie Cotton ended well after midnight, due to their mismanagement and poor leadership.  Staff and district resources were wasted paying the triple digit salaries and overtime of employees like the Superintendent and other staff.

 LIE: Unions were given 5 minutes to address the Board of Trustees and the Public remains at 3 minutes. (January 8, 2015 Board Minutes/Administrative Regulation 9323)

 FACT: Employee Associations (Unions) public comments are still only limited to 5 minutes total.  However, members of the public get as many chances to speak as are on the agenda to speak. For example: if there are 40 items on the agenda, then a member of the public can speak for 3 minutes x 40 items for 120 minutes total. Employee Organizations, were given 5 minutes to present information on behalf of hundreds of employees, this is customary for Public Meetings in California.

 LIE: The asbestos at our schools has not been removed as Gina Clayton-Tarvin has publicly been telling parents and the community

FACT: President Clayton-Tarvin has never said that all asbestos would be or is removed at every school site. She and the board majority gave direction to abate all classrooms, and encapsulate remaining asbestos; this has been done to DSA, OSHA, and AQMD standards. This is no secret, as this discussed at multiple board meetings in Open Session for all to hear.

FACT: Jim Knapp acted in an inappropriate manner to harass G. Clayton-Tarvin and was forced by HBPD to leave the private event. He met outside with Norm Westwell and Kathryn Gonzalez to debrief their actions. All was caught on tape and documented for police review and investigation.

The AHERA reports have shown for years and years and years the district knew about the asbestos in our schools. It was not a problem. Apparently the only one who was surprised to learn about the asbestos was Tarvin, who then needlessly scared everyone that the sky was falling. Now she is taking the credit for “saving the children”. She needs to take credit for wasting tens of millions of tax dollars and not even finishing the job.

FACT: Any resident can question the board in Public Comments. Asbestos and its improper handling was a BIG problem in OVSD schools in 2014 due to mismanagement by prior construction manager. Students were at risk and Clayton-Tarvin safeguarded their health. You can’t spare even one dollar when student health and safety are at risk.

LIES: Tarvin wasting district time and resources on politics while students and parents and the classroom have become the lowest priority:

FACT: Supporting Oak View students and teachers and working to get Rainbow under control is not a waste of district time and costs tax payers nothing. Trustee Tarvin volunteers her free unpaid personal time to serve the school district concerning Oak View and Rainbow. OVSD classrooms are the highest priority.

 FACT: Sue Gordon abruptly retired several weeks after the AQMD Hearing in November 2015 in which Republic Services was ordered to pay over $10M to correct their 40 years of polluting children in Oak View. Gordon’s waste of district time and politicking has shown Rainbow’s lack of making students, teachers, and parents of Oak View a priority. Like Sue Gordon, Jerry Moffat, General Manager has abruptly retired, “retired and moved to Mexico”. Jeff Snow, Municipal Manager, transferred elsewhere. Why are they all gone?

FACT: Chris Epting was fired by the LA Times after 10 years for his violations of the papers Code of Ethics and Policies, as admitted by Chris Epting himself on the Voice Forum (July 15, 2015). He obsessively harasses, libels, and defames Clayton-Tarvin and other HB residents.

LIE: New OVSD Board Policy charging parents money in order to volunteer:

New OVSD Board Policy (1240) which CHARGES parents for the privilege to VOLUNTEER at school with their student. You must submit to a lifetime of police reporting to district administrators.

LIE: New OVSD Board Policy (1240) flowchart illustrating the new complexities now involved just for parents to VOLUNTEER at school. State law already requires volunteers may NEVER be alone with students.

 

FACT: State law does not say that volunteers NEVER be alone with students, as Education Code 45349 shows.  Ed Code 45349: Notwithstanding the provisions of this article, or any other provisions of law, a school district may utilize volunteers in the supervision and instruction of pupils, for instance for before school, recess, and lunchtime, but any such volunteer shall be subject to the provisions of Section 35021, this section says verbatim: 35021.1.  A school district or county office of education may request that a local law enforcement agency conduct an automated records check of a prospective nonteaching volunteer aide in order to ascertain whether the prospective nonteaching volunteer aide has been convicted of any sex offense. Ed Code then follows the school district or county office of education may request that the Department of Justice provide subsequent arrest notification service pursuant to Section 11105.2 of the Penal Code.  OVSD Board Policy follows Ed Code.

Why you should Vote YES on Bond Measure R – $169 Million Bond:

 

LIE: Mr. Larry Pratt questions OVSD Trustee President Gina Clayton-Tarvin on Bond Numbers. Tarvin needs more not less.
FACT: Mr. Pratt questioned the Board, not Gina Clayton-Tarvin specifically. He has the right to speak in Public Comments with his opinions, even if he is mistaken. It is his right to do so. Norm Westwell asked for an even larger tax on OVSD homeowners in 2012. He voted to place a $200M General Obligation Bond on the ballot and campaigned for months, speaking at Back to School Nights in favor of it, handing out flyers to parents, and sending mailers. Now all of a sudden he is against bonds? Where is the transparency?

 

LIE: Gina Clayton-Tarvin fails to properly report her campaign finances. (Transparency is not her thing) . Gina Clayton-Tarvin is under investigation by the Fair Political Practices Commission for allegedly failing to comply with California campaign finance reporting laws. Her blatant lack of transparency and carelessness is not a good quality for our elected leader. Send her home. Stay tuned for the outcome.
FACT: The complaint was filed about a supposed violation from 2012. The FPPC has said that an HB resident, Denise Kavanaugh signed a sworn affidavit to make her complaint a public record. She alleged that four years ago, that Tarvin violated the law in coordinating campaigns with OVTA. This is untrue; as teachers PACs conduct their own Independent Expenditure Campaign in support of candidates, which they have no control over, say in. LIE: As President of the Board of the Ocean View School District Tarvin brought Carol Hansen to our district from the ABC School District where Tarvin has taught for many years. At ABC, Hansen colluded with the teachers union to protect a violent kindergarten teacher with a criminal record and was found by a judge to have fabricated evidence against the principal who reported that teacher to the authorities, in order to demote her for defying the union/administration directive to keep it a secret. This action by Hansen placed students and other teachers in physical danger, all to protect the job of one dangerous teacher. . Gina Clayton has also brought over to Ocean View another pal, Mr. Joe Weber who was a supervisor of Accounting and is now our Director of Fiscal Services. She is filling up our district with her pro-union friends. How nice of her to do this for the children.

FACT: Carol Hansen does not collude with anyone to protect violent teachers. Gina Clayton-Tarvin has nothing to do with Carol Hansen’s supposed actions in any case in ABC USD involving a kindergarten teacher. Clayton-Tarvin did not “bring over” Joe Weber. OVSD HR found him through an extensive vetting process, the board voted on him based on admin recommendation. ABC USD is a stable, highly respected and high achieving school district in CA, OVSD is lucky to get employees like Carol Hansen and Joe Weber.
