Certain behavior can be legal, yet also be uncouth. That is the conundrum that the Santa Ana City Council is struggling with.
Chris Prevatt, a Long Beach resident and employee of the Orange County Health Department, a public agency, has criticized Santa Ana Mayor Pro Tem Claudia Alvarez for stopping Al Castillo, a supporter of mayoral candidate Alfredo Amezcua, at the last Santa Ana City Council meeting.
Prevatt previously criticized Alvarez for stopping Minuteman Lupe Moreno, who also is a gay basher, from, like Castillo, personally attacking City Council members, by name.
I looked at the Brown Act and sure enough, it seems that Castillo and Moreno have a right to misbehave during public commments. Here is the law in question:

First, Chris Prevatt DOES NOT even live in OC! He should preface ANYTHING he types with a disclaimer, aknowledging his SELF-INTEREST. This fool is way out of his league there, so he has to hang on here. GO HOME DUDE!
Second, Dan lives in IRVINE of all places! he rents a small office on Main Street. Madison Alexander DOES NOTHING FOR THE COMMUNITY in Santa Ana. If Dan is such a great damn coach, why does’nt he volunteer where Father figures are needed. This guy is a class A BLOWHARD.
Lastly, These two are lightweights, they want the easy way out, whatever benefits them. They offer nothing back to the community they so often comment on. Here’s a suggestion, DO SOMETHING, quit talking from the cheapseats. I’d even consider your paying for writing lessons for Claudio a community service!

Yes. Try to do all your shopping here in town. That way your tax dollars will stay in Santa Ana. This will help our City and will also help our local businesses, who often employ our residents.
I am doing exactly that Pedroza, but that is spiting in the ocean!

It was not what he said that I took umbrage with, but rather that he stood up and shouted from the audience.
When he did have the microphone, and did follow protocol, he was blathering about Prop. 187 if I recall correctly. I wonder if he knows that his guy Amezcua is allied with Janet Nguyen?

-Call Tom Linnert at THINK TOGETHER offer two hours a week teaching/counseling kids who need help with homework.
-If you actually live here, create a neighborhood watch, this can be done liberally.
– Like Art Said, spend some money here. As much as I despise his politic’s Richardson was right in 1993 when he said, the people come in and then they leave with thier wallets at 5:00 PM. Sound familiar???? Chris P and his 2,313 co workers need to drop some coin here.
– Since I am education centric I’ll keep going on that: Spend some time, not a lot at Willard. I’d venture to guess there are 3-4 kids at that debacle called a middle school who would like to learn Checz (is that the language???) You surprised and amused us all with your AP Birthday wish. So I know you have it in you man. NOBODY runs for a seat on council that does’nt want change. You are WAY more welcome at my beer party than guys who sit back and type!
I guess my point was, however convoluted, is people like Michelle Quinn (who I still think is a two hundred pound white guy in Morrison Park!) do more for a community than a couple of wanna be politico’s from LA COUNTY and Northwood.

I don’t mean to sound like a real sick bastard (OK I lied, I am!), but did you forward the comment to Penthouse Letters or Hustler? I’m sure they are always looking for new submissions. The Council will look at the case law and adjust their approach. I do hope they will start arresting those who speak out of turn or who otherwise disrupt the meetings.
Folks should have their say but they should follow protocol or pay the price.

No I am not. I was very clear in stating that the public has a right to make negative comments at the Council meetings. The question I posed was, given that right, should people be rude and misbehave?
I have NEVER acted rudely at a Council meeting. I fill out my card, turn it in, then make my comments. The Usual Suspects like to shout from the audience – and when they do take the microphone they rarely make any sense.
I cannot repost the video. The video at the Lib OC falls under their copyright. The city does not provide videos online. Your only recourse is to go to the library and check out the DVD.
But why bother? Castillo always harps about the same out of date issues. The Council has gone to the left but he is too clueless to notice. And apparently he hasn’t figured out that Amezcua is in bed with a slew of hater Republicans…

Whatever. Bunch of smoke screen coming from a guy that enjoys freedom of speech day in and day out. With this particular exchange according to the AP Castillo called the mayor hypocritical. Does this warrant cutting off his mic? The funny thing is that the city attorney nor other city council members questioned Alvarez’s motion.

No, not whatever. Again, I was VERY clear in stating that Castillo had a right to speak. I agree that the Council erred in cutting him off. What I question is the value of his utterances, which never relate to anything in the agenda, or are otherwise of import.
That is the bottom line. Yes, folks have a right to speak at the meeting, but should they waste our time with ridiculous rants? I don’t think so.
As for why the motion was not questioned, it is because some city attorneys think that city councils can abbreviate public speakers in this fashion. However, they can’t. It is illegal. I would imagine that the State Attorney General will clarify this and it will be duly noted by the Council. Sadly, Castillo and other gadflies will continue to make spectacles of themselves…

Right on, Art! A GREAT example of this was what happened to Benito Acosta. He was rightfully removed, arrested and lost his subsequent lawsuit against the city. Too bad the residents of Costa Mesa can’t get their $500,000 back. Think of all the recreational programs that money could have funded!
