I must say, I am amazed at the stories that have been posted on this blog in the wake of Al Mijares’ exit from the Santa Ana Unified School District. I am posting this item merely to give SAUSD bloggers a place to post their comments. Post away my friends – we have an opportunity now to finally do away with the corruption left over from the Mijares regime. Change is at hand, but we must remain resolute.
I noted that someone affiliated with the SAUSD administration recently posted a threat on this site – alleging possible legal action against SAUSD employees who post anonymously on this site. That is despicable and a form of terrorism. Do not let fear restrain any of you from revealing the truth.
The final challenge we face in Santa Ana is to replace Mijares with someone competent. We won’t have another opportunity like this anytime soon. This process must be open and focused and whatever else happens we must keep Audrey Noji out of the Superintendent’s position. As a member of the Cerritos College faculty and a member of the teacher’s union at that campus I opposed her when she tried to get a job at our campus. If she goes after the SAUSD superintendent post I will do so again. I know we can do better!
All of my children are in the SAUSD system. For their sake and that of all schoolchildren in the district, I urge those who are rebelling against the last vestiges of Mijares’ broken empire to keep the information flowing and to do whatever it takes to ensure that our next superintendent will be up to the task. Mijares certainly was over his head throughout his doomed tenure.

Poster 11/14/2006 4:38 PM made several prolific comments but again proved as during our earlier debate that he or she’s thinking may not always be right, but is never wrong, at least in his or her mind.
Despite some poor wording on other posters part, I believe the intent of the other comments were to state that the background of the plaintiff, no matter what it is or isn’t, does not belong here on a blog. Neither does the background of the defendant as it pertains to this discussion. Actually I question if this discussion, until resolved in court, even belongs on this blog at all.
Poster 11/12/2006 5:56 PM does imply that the plaintiff has some sort of background and then discredits him or herself by asking if looking into that background was Cecilia’s job too instead of Mr. Lopez’s. Here again someone is trying to muddy the water and subtly discredit the plaintiff. So let’s take that a step forward as long as we are in the mud.
Cecilia’s technical job is parent involvement coordinator. Parent involvement coordinator by title definition has nothing to do with inter employee relations legally or otherwise.
If anyone looked at this logically one might ask themselves why a parent involvement coordinator is a job in the school police department instead of pupil support services. The definition of pupil support seems more applicable to such a job rather than the police department where the primary function is the safety of the staff and students and enforcement of law.
Granted their is interaction between the two divisions but the line of demarcation is defined strongly enough as to make anyone wonder why such a position, created only approximately a year ago, was placed within the police department in the first place.
While Mr. Navarro’s comments are sometimes unclear I surmise these are some of the questions he also had in his position during the election. I also question if these activities could possibly be linked to the placement of Cecilia’s job within a department where the leader faces legal litigation and then one of his subordinates ran for board.
With Sal’s election to the city Ceciia still may get on the board. If she does then I suppose all our questions will be answered.

Im all for community being on the superintendent search but Jo Ann Ramirez is not the right person. I heard she had to resign from the Historical Society because she made enemies and the rumor in SA is that she leaves havoc in her path.

While I’m pleased at the outcome of the election, I would not call a 765 vote win by Noji a mandate. I hope this is a wake up call for her to put into motion a comprehensive teaching program, investigate the allegations of administration mismanagement, harassment, and intimidation of both teachers and non teaching employees.
I would hope she would look into the corruption alleged in many areas of the district. I would also hope she will address the nepotism of husbands supervising wives, wives supervising husbands, and brothers supervising brothers that is apparently going on in several areas of the district.
If she can’t address these issues then this should be her last chance to turn this district around and should be recalled. Personally I’d give her 6 months to prove she is addressing these matters and a year to clean them up or suggest she be removed.
I supported her but I don’t believe that means she has cart blanche to continue the district as status quo.

I sincerely hope they replace Dr. Stainer, Dr. Bratcher and other incompetent administrators at the top. How can the school district improve education when there are so many incompetent people leading the school district?

Last week an emergency meeting was held at Valley/ Godinez High. At the meeting it was announced by Louis Bratcher and Juan Lopez that Tony Espinosa was being removed as the principal at Valley/Godinez. The principal of Century, Greg Rankin, will report for duty as the new principal at Valley/Godinez on December 18, 2006. Margie Salcedo will take over as the principal of Century. Espinosa will report to Chavez as the night school principal where 40 student are enrolled and the position is funded by grant money.
Jane Russo, her cabinet, and the new school board have made very wise decisions. Rankin is reputed to be an excellent administrator who will bring sanity and leadership back to Valley. Margie Salcedo is a wonderful and tireless administrator who has a real talent for recognizing and cultivating talent. Margie, I am sure, will do a fabulous job as the new principal at Century. Tony Espinosa should make every effort to look for work in some other district/profession as I am sure he will not be an employee of SAUSD next June.
A word of advice for Mr. Rankin. There are three areas at Valley/Godinez that need your immediate attention. First, teacher morale at Valley/Godinez in in the toilet. In the first six weeks you need to reach out to the staff, listen carefully to their suggestions, pay close attention to their concerns and act quickly to make changes. Simply by accident and certainly not by the design of Espinosa, you have a good administrative team at Valley/Godinez. Give your team room to do their jobs and support their decisions. Your teachers have been cowered and intimidated by Espinosa and consequently your teachers trust no-one and are afraid to do anything that will bring attention to themselves. Hence there is no innovation, no chance taking, and therefore no progress toward bringing up State scores.
Second. There are teachers at Valley who have literally cashed in on Espinosa’s largess while deserving and more talented teachers have been dumped on. You need to break up the husband-wife team operating in the counseling center. Both people have served their own interest and the interest of Espinosa at the expense of the students and teacher at Valley High. They collect an estimated quarter million dollars per year in salaries and stipends and overtime. They go to conferences all over the country and share nothing they have learned with the rest of the staff. They recruit students to spy on teachers thereby contributing to the collapse of morale at Valley/Godinez. You have a librarian who collects an extra two thousand dollars per month for tutoring students after school but actually tutors no-one. You have a literacy coach/English Department chairperson who does not teach thereby increasing the class load for all English teachers. Look closely, keep your eyes open and beware of new friends bearing promises and gifts. They will almost certainly be the same folks who have helped destroy Valley under Espinosa.
Third; Mr. Rankin, you must get the student body under control. The school is severely overcrowded. The school is staffed with far too many substitute teachers who have no buy in to the school culture. Classroom discipline in these sub teacher classes is non existent and that lack of discipline spills over into other class rooms spreading like a gasoline fire. Espinosa refuses to suspend students because of his misplaced attachment to ADA. Teachers who write referrals to bring order to their classes are checked by student service administrators acting on the orders of Espinosa. Referred kids are immediately sent back to their classrooms without feeling any consequences where they resume their disruptive behaviors.
Mr. Rankin, despite the former principal’s destructive tenure, you none-the-less have a diamond in the rough at Valley/Godinez. Take the time, but be quick about it, and make the school yours. With good ethical leadership and a comprehensive and understandable plan, Valley/ Godinez could emerge as one of the finest schools in SAUSD if not in Orange County.

To poster # 480 Your information is incorrect, Yes Greg Rankin has been assigned to Valley West as Principal, but only until they have found a premanent replacement. Greg Rankin is going to be the new Principal at Godinez High. This was told to me and others in a meeting with the Sup. Jane Russo.
Saddleback’s principal has lost every one of her grievances this past year. Her focus is on older, experienced teachers. It appears that she is practicing age discrimination in who she targets to attack. How can SAUSD afford this kind of irresponsible behavior? The reason she didn’t have an attorney (post # 482) at that meeting was probably because she has run out of district funds to use for attacking employees.
Here is a link to teachers who won an age bias case against a similar harassing personality that the their district allowed to mistreat others for far too long.
The first teacher to bring a claim against the district was awarded $40,000. Two more teachers file suits and because the district had already been found guilty of harboring that bully, the teachers were awarded $360,000 by the district’s insurance company.

Know your union contract whether you belong or not. It is usually posted on the web so you can make your own booklet if you don’t belong.
Get the county policy manual. It is big and thick.
Get the teacher’s manual. Get the Education Laws book from your state capital. Get the manual for the contract you sign with the county. Remember that contract you sign? It’s not with the union but with the county.
Now read and understand. Write down questions as you go. For instance, nowhere in my information did it tell me that the school district had to respond within 30 working days for the Level 3 grievance after you filed it. Even though you have all this information, conveniently, timelines are left out. If you miss a timeline for filing you are out of luck. Don’t rely on the union to file the grievance. You do it yourself and always, always send it certified mail. Or FAX where you can prove the date and that you sent it.
Be sure of your rights and the procedures BEFORE you have the levels of grievance. Do you have a right to tape record? Are they? Can you enter copies of documents, witnesses? A lot is left out.
All questions should be sent in writing documented the way I said. Otherwise what someone tells you over the phone could be incorrect. Always ask in writing what other procedures, and teacher rights are involved at this level AND
tell them to PLEASE not refer you to the contract.
Understand there is the union contract and then the school board to teacher contract. You know, the one you must sign every year. They hide all your rights in different locations. If at the grievance they pull something on you that was not in the written policy book, contract etc. or answered in your requests tell them to hold on and show you where it is located in the material made available to teachers since you asked in writing for all applicable information. If it is a trick, stop the procedings due to incorrect procedure or administration’s omisssion to supply all the requested material you asked for in writing yet here they are presenting what they didn’t suppy you. Inform them that you request the procedural information just now being made available to you to be sent to you and that the grievance must be rescheduled within the ten days or whatever timeline your county has. Then get up and leave and put everything in writing and send it certified mail or FAX to everyone at the meeting. Including your request for the grievance again. Nofify the Labor board about it too and let the school district know that you did. Remember, the union is not your friend. They like their cushie jobs and don’t want to rock the boat of the school board. I was told by Yvonne Lyons of HCTA over the phone, “No, Mrs.____. We are not your advocates. We are your bargaining agents. It it is up to YOU to know your rights under the contracts.” This after being told by her that I was a problem teacher.
You can’t be lazy. Do it yourself and don’t be intimidated. This is their game. Buy a quality hand held tape recorder from radio shack. Don’t be cheap about it. Learn how to use it with all its gadgets and keep fresh batteries in it. NEVER record secretly in private meetings. If it is out in the hallway or public place where anyone passing by or sitting such as a cafeteria- there you can secretly record. Besides its being illegal, you can’t use it in any legal proceedings. Be ethical. When you whip that out in meetings the administrators refuse to talk to you.Tell them you’ll wait while they get a recorder.Don’t rely on a union “WITNESS”.Get it on audio or walk out. Then tell them to email or write you a signed letter. This gets you a hard copy. My principal thought she’d play cute and mess up the hub of our grade level’s joint printer. I reported it to her boss and everyone else via email and told them this was the only way I could get a hard copy of what she said. I also let my attorneys know what game she was playing. IF you have no attorneys and belong to the union (whY?) let them know. Let the Labor board know too. A horrible email was sent to a friend of mine at our school. Her printer didn’t work so she waited until she got home to access the system to print it. Guess what? It had been erased already. So make sure your computer’s printer is up and running or get a letter in signed writing or- audio tape it publicly. It stops a lot of stuff. Also, email to administration while copying it to her boss, union, – infractions of the contract, hostile working conditions, inappropriate behavior, lack of support with parents or students, Unhealthy working conditions,contact OSHA, etc. Keep your hard copies.
If you are out because of stress and bullying, when you come back, put on the sick leave form all the medical stuff and add due to hostile working conditions.
When I started doing that I made a copy for myself and remember it goes downtown. Just be sure you have your doctor’s backing.
I carried my hand held recorder everywhere because my principal would abush me on the sidewalk. You have a right to do this. Any doubts pay the consult fee to an attorney in your state.
**Keep a dated, daily WRITTEN log of what happened that day -even if you have to stop to walk over to write down what came over the intercom. Keep it hidden and take it home every night.Who was there, who heard it, time, etc.It is admissible in court. Keep your opinions out of it unless you describe fear, stress, confusion over contradictory orders etc. NO ANGER, IMPATIENCE etc. Hope this helps.
Saddleback has become a school with no focus and no chance of success. It has been in steep decline since Ms. Jones arrived and the opening of Segerstrom has accelerated the process.
The administration has no ability to gain control of the situation because they view the staff as the reason that the school fails the students. The actual reasons for the decline of the school are well known to the staff but difficult to admit. Support for the instructional programs has declined, time for instruction has decreased(testing,SSR,etc.), students are not as well prepared, mistrust of administration, disorganized administration, some facilities are in poor condition, problems are never solved they just get talked about forever. Saddleback is now one of the most disorganized high schools in the district. Very sad.
I’ve just learned the Trial against the School Police Chief and Larry Seroter began last week and is continuing the week of December 11th. ThIs trial should be open to the public.
It was moved for some reason from the main Superior Court Building on Civic Center to the 909 N. Main Street Court Room C-67, Judge Monarch.
It appears that some employees are standing up to the injustices!

First of all I am not a teacher but a classified employee, but I’m glad to see you certificated people start to get the message.
Your Union, like ours is restricted in what they can do. You have to have the kahonees to stand up to the administration.

Some 200 posts back I wrote that a state takeover was the only true answer. But I’m willing to give Russo a chance. Yet I’d rather see a takeover just to shake up this mess.

Because the relationship between supervisor and employee is inherently unequal, an employee confronted by a supervisor with behavior that a reasonable person would find offensive such as yelling, name-calling, profane, sarcastic, belittling, or other inappropriate language is a victim of workplace intimidation and bullying because the employee cannot react as though the assault came from an equal. Such behaviors constitute threats to an employee even if no direct threatening language is used.
The threat is implied in the nature of the relationship, a supervisor can do things to the employee from writing a negative evaluation to termination, therefore the supervisor will be held to a higher standard of review in supervisor-employee confrontations. The offense is aggravated if it occurs in front of co-workers or third persons such as Postal customers. Angry shouting, abusive, profane or other inappropriate language demeans and humiliates an employee, and has no place on the workroom floor….
When such behavior is the supervisor’s everyday management style on the workroom floor, there is a presumption that a hostile work environment exists, and more stringent remedies may be taken to correct the situation.

The removal of Antonio Espinosa, Valley West principal, is long overdue. The timeliness of Espinosa’s reassignment confirms what district parajitos are saying — the state had a heavy hand in removing Espinosa from Valley.
It’s a sad day when the state has to interevne and direct the district to take action.
Yes, the second sexual harassment case is currently in a jury trial against SAUSD and now entering the jury deliberation stage. This happened because administrators refused to fix problems with Larry Seroter and SAUSD Police Chief Jim Miyashiro.
This is the second legal sexual harrassment case I am aware of involving Seroter, Miyashiro and the SAUSD not dealing with this problem. I was told the first case cost SAUSD and tax payers hundreds of thousands of dollars in a settlement.
Why does our board tolerate incompetent administrators who refuse to deal with these issues? Why are our tax dollars paying to protect this alleged lewd behavior?
We need to step out of the “good ol’ boys system” both with the city and SAUSD.

Actually, #498, you are incorrect. There was a settlement on the Miyashiro sexual harrassment case in June because the SAUSD district lawyers knew they would lose if it went to trail.
The defendent received, I think, around $200,000 from SAUSD.
When a district pays that much money for a settlement, it means there was sufficient evidence.
Isn’t it sad and sick that our taxes are being used to protect sexual harrassers in court?
This is more money taken away from educating Santa Ana kids because top district administrators failed to hold sexual harassers accountable.
It is a relief that some of these bad administrators are gone. However, more “house cleaining” still needs to happen.
Also, the district should implement effective staff development for all district employees to be aware of sexual harrassment and a clear, safe procedure established to ensure harrassment is not tolerated.
wait. I made an error. The other sexual harrassment case was against Seroter and was settled last summer because the SAUSD attorneys feared losing in trial.
The current sexual harrassment case involves both Miyashiro and Seroter. I have seen no evidence that Miyashiro was dropped from this case.

I heard that Don Trigg, Assoc Supt of Business Services is now working part time, but still gets paid full salary.
Apparently, Trigg does not work Fridays and only works half of Thursdays.

This blog is filled with B.S. Does anyone ever take time to check what is true? I have spoken with someone at the court and at the District (public information). There was only one pay out for sexual harrassment and that was against a guy named Seroter. It was not for hundereds of thousands of dollars like the blogger states. It was done for cost reasons based on attorney fees. The second case against Seroter and Myrashiro went to court because it’s a scam. The judge did throughout Myrashiros case(I checked the court recorded) and Seroter may be prevail. So far the jury is deadlocked on Seroter. Why do you people make up untrue stories? Why is this blog allowed to post garbage? I know there are people out there seeking legal action against this site for allowing the B.S. to continue. Lets use this site correctly and talk about educational issues. Stop the B.S.
At Tuesday Nights Board meeting the Board had Election of Officers:

V.P.-Rosemary Avila
Clerk-Audry Noji
They will also be interviewing potential board members in January in the board room. It will be open to the public.
Let’s now see what Rob will do as President. Let’s see if he’ll get rid of Miyashiro, Jones, Lopez, Trigg and the rest of the bunch.

BS is a good term for it. Spoken to “someone” at the court? Spoken to “someone” at the districts public relations office? Yeah thats real firm information. The court is going to give out information for an ongoing case and the district is going to give out information regarding a lawsuit against them.
The fact is the jury is still out on this case. The reason this blog lets people post BS is so someone like you can put up a zero point that means nothing. You have no facts and basically don’t have a clue what you are talking about or you would have printed them.
If the jury comes back in your favor then you can gloat but until then I would suggest you wait and see.
By the way Seroter was boss of police Chief Miyashiro during the alleged incidents. At least get your facts straight or improve on your writing ability to clearly state the point you are poorly trying to make.
There is no way you would know if the jury was deadlocked on dinner, much less the case.
Assuming you are right, which you aren’t, what do you think the attorney fees would be? Did it ever occur to you that if the district fired these SOB’s they would not have all these attorney fees?..God I hope you aren’t a teacher!

What is your source regarding the settlement payout by SAUSD in the sexual harassment case last summer?
What exactly were the fees paid?
Why would the SAUSD have paid out if their lawyers were not fearing a trial?
If you really think this is BS, then please provide proof.
#509 is right. The district would not see these kinds of cases filed if the top admin. dealt with these problems properly.

District administrators have been very successful at fostering numerous parent organizations. This tactic has prevented the formation of ONE cohesive parent organization. Mijares and Noji have been successful at creating strife amongst the PTA, PTO, Promotores and DAC organizations. SAUSD has 55,000 students and that
translates to 100,000+ parents. One parent organization, with just 20% parent participation, would be powerful.
The current administration supports this tactic. It’s time for the parents to flex their parental rights and demand ONE parent organization suited to meet their needs.
Some inroads have been made in cleaning up the district and that’s why it’s important the next superintendent is a non-SAUSD administrator.
Tuesday’s superintendent search update revealed there is another round of interviews. Apparently no one candidate has the 3 votes necessary to be appointed.
Hmmm… watch the provisional appointment of the vacated school board seat.
Unfortunately Tony Espinosa has been reassigned to lead the district’s Graduate Success Program. His previous high school -Valley – has the worst high school graduation rate in the district, if not the county.
Current district administrators are incompetent. It’s time to cast the shackles of cronysim.
An update on the SEXUAL HARRASSMENT LAWSUIT AGAINST LARRY SEROTER & The socalled Chief of Wanna Be Cops.
Jim Miyashiro is indeed a sexual harrasser. Look at his past. He’s a married man and knocksup Myra Lopez. They have a daughter whom he does not acknowledge to the public as though she doesn’t exist. People are saying that the case against Jim Miyashiro was dropped. IT only makes me wonder why it was dropped! Do I smell a settlement without the courts being involved? He had a lot to lose, don’t you think? Who wouldn’t be afraid? What happened to Gene Clough? Bye Bye Mr. Clough, you harrassed your employees? What did you expect?.: The administration at this District has always looked the other way or brushed it off when it came to complaints about Management. Let’s see type of job Jane Russo does. People don’t sue just to sue, they do it because Management fails to protect their rights and employees end up being retaliated against.
The Jury in the current lawsuit is still deliberating.
In the future, all court proceedings are open to the Public. This case was not closed to the Public. From what I know, it was moved to Main Street due to a conflict of scheduling with the prior Judge.
Before you all try and think of defending The Chief of Police, think twice, he’s thinking of making all his security guards 11 months because he’s trying to save the District money. Sure, the District needs him to save them money so the District can pay for his attorneys.

Clarification: Larry Seroter was not Jim Miyashiro’s boss. John Bennet was. Let me tell you all something important, if you don’t know what sexual harrassment is, please don’t make comments. There is no payout large enough, for the discrimination you have to put up with on a daily basis. It happens to men and women.
My hats go off to both these women that stood up for themselves. They had the courage to stop the intimidation and the harrassment. This should never occur especially in the workplace.
If you have daughters, try and picture someone doing that to them. It doesn’t feel right, does it?
I have a comment on the sexual harrassment trial. All the witnesses for the District are a bunch of liars and I hope you can all sleep. Hope this harrassment never happens to anybody you care about.
This is public information so go look it up and see what they all said. It’s a fact that they lied.
THe jury in this case is not deadlocked on Uncle Fester (Larry Seroter) there still delibeating. Also, the Court does not give information on an ongoing case especially one in trial. Keep yourself updated and correct attend the trial and you’ll be accurate on your comments on this website.

Thank you for the clarification. I stand corrected. I don’t remember seeing Mr. Bennett’s name listed on any of these lawsuits. So I wonder who Miyashiro really worked for or with.
By the way have you ever seen one of the police commissioners badges handed out to a selected few administrators complete with ID? The badges were identical to the school cops badges. Possibly you know. Where is the district police commission? Who created it? Who are the members? What do they do?
