Under the heading of NEW BUSINESS of the Sept 26th meeting of the Rancho Santa Margarita city council is item #7 a RESOLUTION which reads as follows:
RECOMMEND THE ADOPTION OF RESOLUTION IN SUPPORT OF THE PROPERTY OWNER AND FARMLAND PROTECTION ACT (Government Acquisition, Regulation of Private Property. Constitutional Amendment. Initiative 07-0015) (Council Member Blais)
RECOMMENDATION: That the city Council adopt the following Resolution:
A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF RANCHO SANTA MARGARITA ADOPTING RESOLUTION IN SUPPORT OF THE PROPERTY OWNER AND FARMLAND PROTECTION ACT (GOVERNMENT ACQUISITION, REGULATION OF PRIVATE PROPERTY. CONSTITUTIONAL AMENDMENT. INITIATIVE 07-0015)
On behalf of the three co-sponsors of this Initiative, and all the volunteers engaged in this fight, we thank the RSM city council for this action which might be a first in CA.
We also suggest that every other CA city simply copy the above boilerplate, pass a RESOLUTION, and let their voters know that they do care about protecting our real property from government “takings” when said property is not for a valid public use and when it is “not for sale.”
I will be attending the RSM council meeting to personally commend them for this pro-active effort.
A word of caution. There is “another” Initiative gathering signatures whose title is very misleading. Furthermore it does not protect faith based institutions, family farms, investment properties or small businesses. It is basically the same language of ACA-8 which failed to gain approval in the state legislature.
That other Initiative is labeled “Homeowners & Private Property Protection Act” and is listed under A.G. file #07-0018. It’s title and protection is very misleading.
