Having helped a friend move into a new house over the past few days it dawned on me that should ACA-8 DeLa Torre be approved by our legislature, our friends home would not be protected against an eminent domain “taking.”
It’s but one of many flaws found in the ill conceived Constitutional Amendment.
Section 19 of Article I of the CA Constitution would be amended to protect only those owner-occupied residence that is the “owner’s principal place of residence for at least one year prior to the State or local government’s initial offer to purchase the property.”
That being the case, 477,460* California families, who purchased single family homes in calendar 2006, are at risk of losing their property. *Source. CA Board of Realtors.
This will be but one of the flaws in this proposal that I plan to attack in addressing eminent domain initiative activity before the Valley Vote organization meeting in Van Nuys this evening.
