Obamacare Mandate Upheld as a Tax, Not as Regulation of Commerce

I personally think that they probably made the right decision in not upholding the mandate on Commerce Clause grounds (i.e. forcing someone to buy something just because they are living- my interpretation, probably not the courts) and instead calling it a tax. Although, I am surprised that the courts said it was a tax since it was my recollection that the Administration’s argument was that it was not a tax- maybe they did not argument that before the SCOTUS but I thought that it was played out that way during the legislative process. It feels like a tax and the government has a right to tax and looks like those who voted for it will have to say that they raised taxes on a lot of people, but I presume that they would think that the tax is worth the benefit.

hmmm… that’s a pretty abrupt ellipsis, I have a feeling it continued, “…Antonin Scalia and Sam Alito.” Sully wouldn’t be doing a FOX News on us, would he?
Plus, Roberts is Mr. Citizens United more than anything else; I appreciate him fixing up Obama’s law and handing it back to him with a bow on it, but it’s easy to see how a corporatist wouldn’t mind Obamacare. Today we will celebrate Roberts’ reasoned decision; tomorrow he’s a villain again for the vast body of his work.
*The brouhaha over what is a tax…is a crack up. The Family Child Tax Credit….is only for people with Children. The Home Owners Exemption…is only for Homeowners…..the Business Expense Deductions are for only people with Businesses…….
As you can see the TAX CODE is not equitable or fair to all ….is it? Every tax deduction for medical expenses that exceed a certain percentage of your income again is never equitable.
The money given to various Federally Approved Charities in amounts to choke a horse are also write-offs and not equitable. What you pay for Car or Health Insurance are also payments that may or may not be considered tax write-offs for various people.
So….they just expaned who gets the write-off and who needs pay to get it. Healthcare..that is.
